Thank you for using Custom Cook ("App", "Service", "we", "us", or "our"). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our iOS application. By downloading or using Custom Cook, you agree to the practices described in this Privacy Policy.

1. Information We Collect

1.1 Information You Provide Directly

Account Information: When you create an account, we collect your name, email address, username, and password (stored in encrypted form).

Profile Information: Profile photo, bio, and other optional profile details you choose to provide.

Recipe Content: All recipes you create, edit, modify, or upload, including ingredients, instructions, photos, tags, notes, nutritional information, and any other content you submit through the App.

Cookbook Content: Cookbooks you create, their titles, descriptions, cover images, and organizational structure.

Communications: Messages or feedback you send to us directly.

1.2 Information Collected Automatically

Device Information: Device type, operating system version, unique device identifiers, and mobile network information.

Usage Data: Features you use, pages you view, time spent in the App, crash reports, and performance data.

Log Data: IP address, browser type, access times, and referring URLs.

AI Interaction Data: Prompts you submit to AI features, images generated, and recipes created or modified using AI assistance.

Analytics Data: Aggregated, anonymized data about how users interact with the App to help us improve the Service.

1.3 Information from Third Parties

If you sign in using a third-party service (such as Apple Sign-In or Google), we receive basic profile information as permitted by that service and your privacy settings.

2. How We Use Your Information

We use the information we collect to:

• Provide, operate, and maintain the App and its features.
• Create and manage your account and authenticate your identity.
• Enable you to create, edit, save, and share cookbooks and recipes.
• Power AI features including recipe generation, recipe editing, and AI-generated images.
• Improve, personalize, and expand our App and services.
• Train, fine-tune, and improve our AI models and algorithms using recipe content and AI interaction data (see Section 4 for details on recipe content rights).
• Communicate with you about updates, new features, and promotional content (where you have opted in).
• Monitor and analyze usage patterns and trends to improve user experience.
• Detect, prevent, and address fraud, abuse, security incidents, and technical issues.
• Comply with legal obligations and enforce our Terms of Service.
• Respond to customer service inquiries and provide support.

3. Sharing Your Information

3.1 With Other Users

When you share a cookbook or recipe with other users, those users will be able to view the content you share. Please be mindful of what you share publicly or with specific individuals.

3.2 Service Providers

We share your information with third-party vendors and service providers that perform services on our behalf, such as cloud hosting (e.g., AWS, Google Cloud), analytics providers, AI service providers (e.g., OpenAI), email delivery services, and customer support platforms. These providers are contractually obligated to protect your data and use it only to perform services for us.

3.3 Business Transfers

If Custom Cook is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will provide notice before your personal information becomes subject to a different privacy policy.

3.4 Legal Requirements

We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court order or government agency), or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

3.5 With Your Consent

We may share your information for other purposes with your explicit consent.

3.6 Aggregated and Anonymized Data

We may share aggregated or de-identified information that cannot reasonably be used to identify you with third parties for industry analysis, research, or other business purposes.

4. Recipe Content and Intellectual Property

IMPORTANT: By submitting, creating, uploading, or generating any recipe, recipe modification, cookbook, or related content ("Recipe Content") through the App — whether created manually or with AI assistance — you grant Custom Cook a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to access, use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Recipe Content for any purpose, including but not limited to:

• Improving and training AI models and algorithms;
• Marketing, promotional, and advertising materials;
• Research and development;
• Sharing within the App or third-party platforms;
• Commercial exploitation in any form now known or later developed.

You represent and warrant that you have all rights necessary to grant this license and that your Recipe Content does not infringe the intellectual property rights of any third party.

5. AI-Generated Content

The App uses artificial intelligence to generate recipe images, create new recipes, and edit or adjust existing recipes. By using these AI features, you acknowledge and agree that:

• AI-generated content may not always be accurate, complete, or appropriate for your specific dietary needs or restrictions. Always verify recipes before preparing food, especially if you have allergies or health conditions.
• We do not guarantee the accuracy, safety, or nutritional content of AI-generated recipes.
• AI-generated images are for illustrative purposes only and may not precisely represent the finished dish.
• Your prompts and inputs to AI features, along with resulting outputs, may be used to improve our AI systems as described in Section 4.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the Service. We also retain and use your information as necessary to comply with legal obligations, resolve disputes, and enforce our agreements. When you delete your account, we will delete or anonymize your personal data within 90 days, except where we are required to retain certain information for legal or legitimate business purposes. Recipe Content may be retained in anonymized or aggregated form even after account deletion, as described in Section 4.

7. Your Rights and Choices

7.1 Account Information

You may access, update, or delete your account information at any time through the App's account settings. Deleting your account will result in the removal of your personal profile data; however, Recipe Content previously licensed to us remains subject to the license in Section 4.

7.2 Marketing Communications

You may opt out of receiving promotional emails from us by following the unsubscribe instructions in those emails or by adjusting your notification settings in the App.

7.3 Push Notifications

You can disable push notifications at any time through your device settings.

7.4 California Residents (CCPA)

California residents have the right to know what personal information we collect, the right to delete personal information, the right to opt out of the sale of personal information (we do not sell personal information), and the right to non-discrimination for exercising your rights. 7.5 European Users (GDPR)

If you are located in the European Economic Area, you have the right to access, rectify, port, and erase your data, as well as the right to restrict and object to certain processing. You also have the right to lodge a complaint with your local supervisory authority. To exercise your rights, contact us at legal@customcook.app. Our legal basis for processing personal data includes performance of a contract, legitimate interests, compliance with legal obligations, and consent.

8. Data Security

We implement industry-standard security measures to protect your information, including encryption of data in transit (TLS/SSL) and at rest, secure authentication mechanisms, regular security assessments, and access controls limiting employee access to personal data. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security. In the event of a data breach that affects your personal information, we will notify you as required by applicable law.

9. Children's Privacy

Custom Cook is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will promptly delete such information. If you believe a child under 13 has provided us with personal information, please contact us at legal@customcook.app.

10. Third-Party Links and Services

The App may contain links to third-party websites or services. We are not responsible for the privacy practices of such third parties and encourage you to review their privacy policies. This Privacy Policy applies solely to information collected by Custom Cook.

11. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence, including the United States, where our servers are located. These countries may have different data protection laws. We ensure appropriate safeguards are in place for such transfers in accordance with applicable law.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy in the App and updating the "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the updated policy. We encourage you to review this Privacy Policy periodically.
